Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the KuraNhaka platform — including the KuraNhaka mobile application for Android and iOS, this website, and related services — operated by Bright River Marketing ("BRM", "we", "us"), a Zimbabwean company based in Harare. By creating an account, submitting a form on this website, or otherwise using the platform, you agree to these Terms. If you do not agree, please do not use the platform.

1. About the platform

KuraNhaka connects resilient farming practice, farmer registration and verification, training, advisory, data intelligence, finance readiness, input access and market linkage. The platform serves several roles — farmers, extension officers, depot agents and aggregator depot agents — and different features are available to different roles.

2. Eligibility

• You must be at least 12 years old to create a profile. Users under 18 should use the platform with the involvement of a parent or guardian, especially for any programme with financial commitments.
• You must provide accurate registration and identity information, and you may only register on your own behalf (or on behalf of another person where the platform expressly provides for assisted registration by an authorised officer, with that person's consent).
• Entering into input, finance or offtake agreements through the platform may carry additional eligibility requirements set by the relevant partner (such as being of legal contracting age).

3. Your account

• Accounts are registered against your mobile phone number and verified with a one-time code. You then set a password.
• You are responsible for keeping your password and device secure, and for all activity on your account. Tell us promptly if you suspect unauthorised use.
• We may suspend or terminate accounts that breach these Terms, provide false information, or are used fraudulently.

4. Farmer records and data accuracy

• Information you record on the platform — profile details, farm and field boundaries, activities, yields and deliveries — is used for verification, scoring and programme decisions. You must ensure that what you record is true and accurate.
• Farm and field verification may involve accredited extension officers reviewing your information and visiting your fields.
• Deliberately recording false information (for example inflating field sizes, falsifying activities or misrepresenting identity) is a material breach of these Terms and may result in removal from programmes and the platform.

5. The Nhaka Index

The Nhaka Index is a score generated from your activity and records on the platform. It is provided to help assess readiness for finance, inputs and market programmes. The Nhaka Index is not a promise or guarantee of finance, inputs, contracts or any other benefit. Decisions about specific products are made by the relevant partner institutions under their own criteria and terms.

6. Finance, inputs and market programmes

• Loans, input packages, insurance and offtake arrangements offered through the platform are provided by third-party partners (such as microfinance institutions, input distributors and aggregators), not by BRM. Your agreement for any such product is between you and that partner, under the partner's terms, which you should read before accepting.
• Vouchers issued through the platform may only be redeemed by the named farmer at authorised depots, and identity verification (including photographing your ID document) may be required at redemption or delivery.
• BRM facilitates these connections but is not a party to, and is not responsible for the performance of, agreements between you and partner institutions.

7. Beta programme

• KuraNhaka is currently in beta testing. Submitting a beta request on this website does not automatically enrol you; BRM reviews requests and will contact selected testers with next steps.
• Beta software may contain errors, and features, data and scores may change, be reset or be discontinued during the beta period.

8. Acceptable use

You agree not to:

• use the platform for any unlawful purpose, or to infringe the rights of others;
• access or attempt to access other users' data or accounts, or interfere with, probe or disrupt the platform or its security;
• submit spam, automated form submissions, or content that is misleading, abusive or harmful;
• copy, scrape, reverse engineer or resell the platform or its data, except as permitted by law.

9. Your content and our licence

You retain ownership of the information and photographs you submit. You grant BRM a non-exclusive licence to store, process and use that content to operate and improve the platform, including for verification, scoring, programme administration and the generation of aggregated or anonymised insights, in line with our Privacy Policy.

10. Intellectual property

The platform, including the KuraNhaka name, the Nhaka Index, our logos, software, designs and content, is owned by BRM and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding.

11. Third-party services

The platform relies on third-party services (for example map imagery, satellite data, messaging and hosting providers) and may contain links or advertisements that lead to third-party websites. We are not responsible for third-party services or websites, and your use of them is subject to their own terms.

12. Availability and disclaimers

• The platform is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free or always available, particularly during the beta period.
• Advisory, weather, satellite and scoring information is provided for general guidance only and may be incomplete or inaccurate. Farming decisions remain your own responsibility.
• We may modify, suspend or discontinue features at any time.

13. Limitation of liability

To the maximum extent permitted by law, BRM shall not be liable for any indirect, incidental, special or consequential loss — including loss of profits, crops, income or data — arising from your use of, or inability to use, the platform, or from any agreement between you and a partner institution. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify BRM against claims, losses and expenses arising from your breach of these Terms, your misuse of the platform, or false information you provide.

15. Termination and account deletion

• You may stop using the platform at any time and may delete your account from the app's profile settings, as described in our Privacy Policy. Deletion may be temporarily blocked while you have an active obligation, such as an application under review, an active contract or an unconfirmed delivery.
• We may suspend or terminate your access for breach of these Terms, with notice where reasonably practicable.
• Sections that by their nature should survive termination (including content licences for retained records, disclaimers, limitation of liability and governing law) survive.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the effective date above and, for significant changes, notify you in the app or on this website. Continued use of the platform after a change takes effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of Zimbabwe, and the courts of Zimbabwe have jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer protections available to you in your country of residence.
